自2016年以来，《反不正当竞争法》的修改意见稿重新梳理了商业贿赂的概念与类型；《刑法司法解释九》也再次对行贿、受贿的立案标准与量刑幅度做了与时俱进的调整，同时也对争议较大的定罪情形做了规范。同时，美国的SEC与DOJ的近期处罚中也反映出了最新的执法趋势，而中国的工商机关也首次针对FCPA处罚对象在中国的商业贿赂行为“接力”查处。
